DOJ Under Trump Poised to Settle Colony Ridge Predatory Lending Case, Leaving Hispanic Victims Uncompensated

The U.S. Justice Department is finalizing a settlement in a landmark predatory lending case that would provide zero compensation to the tens of thousands of alleged victims. The deal, negotiated under the Trump administration with Texas land developer Colony Ridge, marks a stark reversal from the Biden-era DOJ's public pledge to secure restitution for Hispanic families it accused the company of systematically defrauding.

In 2023, the DOJ's Civil Rights Division sued Colony Ridge, alleging it operated a 'one-stop shop for discriminatory lending' by targeting Hispanic homebuyers with false advertising and steering them into unaffordable, high-interest loans for plots in its massive subdivisions north of Houston. The lawsuit claimed the company's business model relied on borrowers defaulting so it could foreclose and resell the properties. Assistant Attorney General Kristen Clarke had explicitly stated the government's goal was to ensure victims 'are compensated for their loss.'

The proposed $68 million settlement now on the table allocates $20 million for loan forgiveness and lot improvements but designates no funds for direct victim compensation. This outcome places intense scrutiny on the shift in enforcement priorities between administrations and raises critical questions about accountability in civil rights litigation. The resolution, if finalized, would close a major case without delivering the financial redress originally promised to the affected community, potentially setting a concerning precedent for how similar predatory schemes are addressed.
