GAO Report Exposes Massive Enforcement Gap Against Illegal Vapes in U.S.

A new Government Accountability Office report reveals a stark disconnect between the scale of illegal e-cigarette sales in the U.S. and the federal government's enforcement response. Despite repeated vows from both the Trump and Biden administrations to crack down on illicit, youth-appealing vapes, Department of Justice actions are lagging far behind the scope of the problem, leaving thousands of illegal products on the market.

The report details that between fiscal years 2022 and 2025, the majority of DOJ enforcement actions—50 out of a total of 88—were merely administrative, adding the names of remote e-cigarette sellers to a list of unauthorized businesses. The second-most common action, comprising just 20 of the 88 cases, involved seeking injunctions to stop legal violations. This data suggests a reactive and limited enforcement posture focused more on cataloging offenders than on aggressively removing illegal flavored products that specifically target minors.

The findings place intense scrutiny on the DOJ and the Food and Drug Administration, highlighting a systemic failure to match regulatory rhetoric with meaningful legal action. The enforcement gap creates a permissive environment for a sprawling illicit market, undermining public health goals and raising significant questions about the effectiveness of current federal strategies to protect youth from nicotine addiction.
